To protect your script, it is not necessary to proceed to administrative steps. Indeed, the article L. 111-1 of the code of the intellectual property (CPI) stipulates that "the author of a work of the spirit enjoys on this work, by the only fact of its creation, an exclusive incorporeal property right and opposable to all. This right includes attributes of an intellectual and moral nature as well as attributes of an economic nature".
However, in order to avoid possible conflicts, it is preferable and recommended to take care of what is called the "proof of the anteriority of the copyright" which proves your paternity on your creation.
Which procedures ?
In all, five procedures are available to you to register your work.
Sending a registered letter to yourself
One method is to send your script to yourself by sealing the envelope and never opening it, as the stamp is supposed to be authentic, but the legal value of this procedure is weak. It is interesting to note that the Post Office has the option of sending an electronic registered letter which could constitute a computerized proof.
2. Deposit with a society of authors
This is the most commonly used procedure. The deposit can be done in digital format, remotely or in physical format. For the latter, you just have to download the form to be printed and the society will send you directly an envelope to send back. There are several societies of authors with varying rates.
The Société des Gens De Lettres (SGDL) offers a simple deposit and an online deposit, valid for 4 years and renewable once, for a fee of 45 euros.
The Société des Auteurs Compositeurs Dramatiques (SACD) also offers a deposit service for 15 euros online, valid for 5 years and renewable.
The Société Civile des Auteurs Multimédia (SCAM), proposes, for documentary works, variable rates according to the depositor and the chosen duration.
The Syndicat National des Auteurs et des Compositeurs (SNAC) offers a 5-year deposit for a fee of 37 euros.
The Agency for the Protection of Programs (APP) allows the deposit of software and computer programs.
3. The online deposit or e-deposit
Simple and inexpensive, online filing (or e-filing) allows you to file and pay online directly on the websites of the authors' societies that offer this service (such as the SACD for example).
4. Filing a Soleau envelope
This double envelope, which can be easily removed from the INPI, allows you to insert the documents you wish to protect. Your documents must therefore be inserted in duplicate (one copy in each compartment). Be careful not to exceed the limit of seven A4 sheets. It is recommended to use it as soon as you create your design. It costs 15€ each and must be returned to the INPI.
5. Filing with a notary or a bailiff
This rather expensive process allows a proof of the authorship of your work without time limits. Unless the deposit is considered false (very rare), it is indisputable.
